Delivery Partner Terms & Conditions

These Delivery Partner Terms & Conditions ("Agreement") govern the engagement between SmartChakkii and the individual or entity acting as a Delivery Partner. By accepting delivery assignments, logging into the SmartChakkii system, or performing delivery services, the Delivery Partner agrees to comply with all applicable policies, operational guidelines, and service standards established by SmartChakkii from time to time. The Delivery Partner acknowledges that their role is limited to the pickup and delivery of assigned orders in a timely, safe, and professional manner, ensuring that all products are handled with due care to prevent damage, contamination, loss, or spillage, and maintaining appropriate hygiene standards throughout the delivery process. The Delivery Partner operates strictly as an independent contractor and not as an employee, agent, partner, or representative of SmartChakkii, and therefore shall not be entitled to employment benefits, insurance coverage, provident fund contributions, gratuity, paid leave, or any other statutory or non-statutory benefits typically associated with employer-employee relationships. The Delivery Partner is solely responsible for maintaining valid government-issued identification, driving license, vehicle registration, insurance coverage, and compliance with all traffic laws, local regulations, and statutory requirements necessary to perform delivery services legally and safely.

The Delivery Partner agrees to adhere to assigned delivery timelines and acknowledges that repeated delays, customer complaints, service failures, or operational negligence may result in warnings, financial penalties, suspension, or termination of partnership at SmartChakkii's sole discretion. Delivery confirmation must be completed exclusively through the official SmartChakkii platform, including but not limited to QR code scanning, OTP verification, digital acknowledgment, or system confirmation, and any false reporting, manipulation of records, or fraudulent confirmation shall be treated as a material breach of this Agreement. In cases where cash-on-delivery services are applicable, the Delivery Partner assumes full responsibility for safeguarding collected cash and depositing or settling the amount within the prescribed timeframe, failing which SmartChakkii reserves the right to recover dues, impose penalties, or terminate the engagement.

The Delivery Partner shall maintain professional conduct at all times, including respectful interaction with customers, adherence to grooming and identification requirements (including uniform or branded identification if mandated), and strict avoidance of unauthorized activities such as collecting additional charges, promoting third-party services, misusing customer data, or representing SmartChakkii beyond authorized scope. All customer information, including names, addresses, contact details, and order data, shall be treated as confidential and shall not be disclosed, stored, copied, or used for personal or external purposes. The Delivery Partner may be held financially responsible for product loss, theft, misdelivery, or damage arising from negligence, misconduct, or failure to follow prescribed procedures.

SmartChakkii reserves the absolute right to modify delivery allocation systems, compensation structures, incentives, operational policies, or service territories without prior notice, and continued participation shall constitute acceptance of such modifications. SmartChakkii further reserves the unilateral right to suspend, restrict, or terminate the Delivery Partner's access to the platform in cases of misconduct, fraud, repeated non-performance, breach of policy, reputational risk, legal non-compliance, or operational necessity. Nothing contained herein shall be interpreted as creating an agency, joint venture, partnership, or employment relationship. Any disputes arising out of or in connection with this engagement shall be governed by the applicable laws of India and shall fall under the exclusive jurisdiction of the courts located in Pune, Maharashtra. Continued acceptance of delivery assignments shall constitute acknowledgment and acceptance of the terms contained herein, including any future amendments issued by SmartChakkii.
